The Highlands Water Protection and Planning Act (N.J.S.A. 13:20-1 et seq.) protects the source of drinking water for over 5.4 million people and helps preserve New Jersey's dwindling open space. The New Jersey Department of Environmental Protection (NJDEP) readopted, with amendments, the Highlands Water Protection and Planning Act Rules (N.J.A.C. 7:38) on December 4, 2006. These rules implement the Highlands Water Protection and Planning Act, signed on August 10, 2004, and replace the Special Adoption of May 9, 2005. The rules incorporate the requisite standards of various land use, water resource and environmental protection statutes and establish a consolidated Highlands permitting review and approval process for activities constituting major Highlands development proposed in the Preservation Area.
This one-day seminar will explain the Highlands Water Protection and Planning Act Rules implemented by the Department and will describe:
The area potentially affected by the rules
The activities that are regulated and exempt from regulation
How to obtain a Highlands applicability determination
How to obtain a Highlands resource area determination
How to obtain a Highlands preservation area approval
The four types of waivers, what they are and how to apply
In addition, the program will provide an update on the status of the Highlands Councilfs Regional Master Plan (RMP) and will describe the relationship between the Departmentfs rules and the RMP.
